With the reunification of Germany a transformation process took place in the new federal states that was supposed to transfer the economical activities of the state resulting from socialism to the social market economy. Until now, the outsourcing of tasks performed by the state to a third party is still discussed at state level. Claims and realities of the outsourcing of tasks and performances to state enterprises are under study. The triggering point of this matter is the initial will of the legislator to hand over tasks to a third party. However, the step of merely transferring defined tasks within the organisational forms of the state enterprises is then an inconsistent one. For a closer investigation, comparisons are drawn between the exertion of tasks in the federal states of Hamburg, Bavaria, and Rhineland-Palatinate. In order to estimate in which way and to what degree of precision the privatisation in Brandenburg was organised a few questions are raised and developed:
– What are the incentives for the intervention of the state in the market action?
– Under what conditions should the state outsource its tasks?
– What procedures for the outsourcing of the execution of tasks and of the performance of services are prevailing in the state of Brandenburg and in similar states? Are there any appraising procedures?
– Are there any reasonable possibilities and alternatives to the prevailing forms of privatisation in Brandenburg?
